Legal Requirements for Landlords – are you on the right side of the law?

UK law states that anyone who lets residential accommodation as a business activity is required by law to ensure the equipment they supply as part of the tenancy is safe. Under the Electrical Equipment (Safety) Regulations 1994, this includes all mains electrical equipment, new or pre-owned in the following types of accommodation:

  • Houses
  • Flats
  • Bedsits
  • Holiday homes
  • Caravans
  • Boats

The Landlord, or their appointed electrician, must regularly maintain cookers, washing machines, kettles etc supplied with the accommodation to ensure it is safe.

As the supply of goods occurs at the time of the tenancy contract, it is essential to check electrical equipment prior to a tenancy starting. A record should be made of the goods supplied as part of the tenancy agreement and of checks made on those goods. The record should indicate who carried out the checks and when they did it.

It is strongly advisable to have the equipment checked before the start of each let, and it is good practice to have the equipment checked at regular intervals throughout the tenancy too.
